5.2. Client Instructions The Client must identify belongings requiring special care and provide clear instructions regarding storage, placement, and organization preferences.
5.3. Valuable Items The Client should secure cash, jewelry, important documents, irreplaceable belongings, and other high-value items before service.
5.4. Missing Property Reports A report that an item cannot be located after an organizing appointment does not, by itself, establish theft or misconduct. The Company will reasonably review relevant information, including photographs, videos, inventories, communications, and other available evidence.
5.5. Disposal of Belongings The Company will not intentionally discard, donate, or remove personal belongings from the property without the Client’s authorization.
5.6. Legal Responsibility Nothing in this section limits responsibility for proven theft, negligence, unauthorized disposal, or other conduct for which liability cannot lawfully be excluded.
9. Property Damage, Liability & Claims
9.1. Reasonable Care The Company will exercise reasonable care when performing services and handling property within the agreed scope.
9.2. Pre-Existing Conditions The Company is not responsible for defects, damage, deterioration, or wear that existed before service and were not caused or aggravated by Company personnel.
9.3. Reporting Damage Clients should notify the Company promptly upon discovering suspected service-related damage and provide relevant supporting information.
9.4. Investigation The Company may review photographs, service records, communications, and other relevant evidence before determining responsibility or proposing a resolution.
9.5. No Automatic Presumption of Liability The discovery of damage after an appointment does not, by itself, establish that the Company caused it.
9.6. Applicable Law Nothing in these Terms excludes liability for negligence, intentional misconduct, or other conduct to the extent such liability cannot lawfully be limited.
21. Pre-Existing Damage, Improperly Secured Items & Fragile Property Policy
21.1. Pre-Existing Damage Expert Home Cleaners is not responsible for damage, defects, deterioration, or wear that existed before the commencement of services and was not caused or worsened by the Company’s negligence or misconduct. This includes pre-existing cracks, scratches, chips, stains, loose components, weakened materials, damaged finishes, and previously broken or repaired items.
21.2. Improperly Installed or Secured Items The Company is not responsible for damage arising solely from improper installation, inadequate attachment, instability, or defective condition of items, fixtures, or structures, provided its service professionals exercised reasonable care. Examples include improperly mounted mirrors, pictures, shelves and wall decorations; loose light fixtures, ceiling fans and chandeliers; poorly secured cabinet doors, handles and drawers; unstable furniture and storage systems; loose bathroom fixtures; improperly installed blinds and curtain rods; and weakened decorative items.
21.3. Fragile, Delicate & Deteriorated Property Certain materials and items may be unusually fragile due to age, deterioration, previous repairs, improper installation, or inherent material characteristics. The Company is not responsible for damage resulting solely from such conditions during the exercise of reasonable care and the use of appropriate cleaning methods. This provision does not excuse damage caused by improper cleaning products, unreasonable force, negligence, or other misconduct.
21.4. Client Responsibility to Disclose Existing Conditions Clients must notify the Company before service begins of known broken, loose, unstable, or improperly installed items; fragile or valuable belongings requiring special handling; previously damaged surfaces; materials requiring special products or procedures; and structural defects or unsafe fixtures. Clients should secure or remove particularly fragile, unstable, or valuable items before the appointment.
21.5. Right to Decline Handling or Cleaning The Company may decline cleaning, moving, or handling items that appear unstable, excessively fragile, improperly installed, or at risk of damage. Such items may be left untouched when reasonably necessary to prevent damage or injury.
21.6. Documentation of Existing Conditions Service professionals may photograph visible pre-existing damage, loose fixtures, unstable items, or other relevant conditions before beginning work, in accordance with Section 19. Such documentation may be used to evaluate subsequent damage claims.
21.7. Damage Claims & Liability The Company reviews reported property damage case by case, considering the item’s prior condition, evidence, work performed, and whether reasonable care was exercised. The Company is not automatically liable merely because an item was discovered broken or damaged after service. Nothing excludes liability for damage caused or aggravated by Company negligence, improper handling, or other conduct for which liability cannot lawfully be limited.
21.8. Fragile, Valuable & Special-Care Items The Client must inform the Company before the appointment of fragile, valuable, antique, collectible, sentimental, or delicate items requiring special handling or cleaning. These may include art, sculptures, glassware, crystal, porcelain, antiques, electronics, valuable decor, family heirlooms, and items with loose components. The Client agrees to clearly identify these items; provide specific instructions; secure or remove jewelry, cash, important documents, small valuables, and irreplaceable belongings; disclose known defects or unusual fragility; and obtain advance Company approval for special handling.
21.9. Undisclosed Fragility or Special Requirements The Company cannot be expected to identify hidden defects, unusual fragility, exceptional value, or special cleaning requirements that are not reasonably apparent and have not been disclosed. In such cases, service professionals may use reasonable standard cleaning methods appropriate to the item’s apparent type and condition. The Company is not responsible for damage caused solely by undisclosed pre-existing defects, inherent fragility, or special material characteristics, provided personnel exercised reasonable care. Failure to disclose value or fragility does not release the Company from responsibility for negligence or improper handling.
21.10. Right to Avoid Handling Valuable or Fragile Items The Company may decline cleaning, moving, or handling particularly fragile, valuable, irreplaceable, or high-risk items. Such items may be left untouched without constituting incomplete service, and the Client may be asked to arrange for a qualified specialist.
22. Stain Removal, Permanent Discoloration & Mold Policy
22.1. No Guarantee of Complete Stain Removal Expert Home Cleaners does not guarantee complete removal of old, stubborn, deeply embedded, or permanent stains. Certain stains, discoloration, and surface damage may be impossible to remove using standard cleaning procedures without risking damage to the underlying material.
22.2. Standard Cleaning Products & Methods The Company uses standard professional cleaning products, equipment, and methods appropriate for the surfaces being treated. Service professionals are not required to use excessively aggressive chemicals, abrasive techniques, or potentially damaging procedures solely to achieve complete stain removal.
22.3. Permanent Stains & Surface Deterioration The Company is not responsible for the inability to remove long-term dirt or grease buildup; rust, hard-water stains and calcium deposits; permanent discoloration or fading; deeply absorbed carpet, upholstery, grout, or porous-surface stains; or stains on previously damaged or chemically altered finishes. Such remaining conditions do not automatically indicate inadequate cleaning quality.
22.4. Mold & Mildew The Company does not guarantee removal, treatment, or prevention of mold, mildew, or fungal growth. Standard cleaning does not include professional mold inspection, testing, remediation, or correction of underlying moisture problems. At its discretion, the Company may perform limited surface cleaning of minor mildew-like staining when safe using appropriate standard products. This does not constitute mold remediation or guarantee elimination of contamination.
22.5. Right to Refuse Unsafe Cleaning The Company may refuse or discontinue cleaning areas affected by suspected significant mold contamination, hazardous substances, or conditions requiring specialized remediation. Professionals are not required to use methods that may damage surfaces or create unsafe exposure.
22.6. No Automatic Refund for Permanent Conditions The inability to completely remove pre-existing stains, permanent discoloration, mineral deposits, or mold-related staining does not, by itself, constitute unsatisfactory service or entitle the Client to a refund, provided agreed services were performed with reasonable care and appropriate methods.
22.7. Client Acknowledgment The Client acknowledges that cleaning results depend on the age, nature, severity, and condition of stains and affected materials, and that complete restoration cannot be guaranteed.
